In this writ petition the petitioner seeks a direction by way of Mandamus to declare the action of the respondents in not considering the case of the petitioner for admission into MBBS Course under physically handicapped category by taking his deformity, extent of disability as per the certificate, dated 09.05.2013 issued by the Medical Board and the rank secured by the petitioner as illegal and arbitrary.

As per the rules and regulations of admission into MBBS/BDS courses, there is a quota for physically challenged candidates with locomotory disorder of lower limbs between 40% to 70%.

In this writ petition, it is the grievance of the petitioner that in spite of disability, disorder for lower limbs between 40% to 70%, the same is not being considered. During the course of hearing, Sri A.Prabhakar Rao, learned counsel for respondent No.2 submitted that the petitioner was tested by the expert committee properly, and also produced the proceedings of the Medical Board, in the prescribed format. Column No.11(a) nature of

disability is recorded as under:

"DORSO LUMBAR SLOLIOSIS WITH KYPHOSIS, NO LOWER LIMB INVOLVEMENT NOT ELIGIBLE"

In view of the said endorsement by the expert committee of the Medical Board, it is clear that the disability of the petitioner is not locomotory disorder of lower limbs, as such, he is not eligible. There is no reason to doubt the said endorsement, hence, we do not find any merit in the writ petition and the same is devoid of merits. Accordingly, the writ petition is dismissed. There is no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
