ORDER:

The petitioner is a Field Assistant appointed in the year 2010. While working as a Field Assistant, alleging that the petitioner has produced false certificates of eligibility and social status and for illegalities in supply of plants, disciplinary proceedings were initiated on 19.09.2014 and the petitioner was placed on temporary suspension, while calling for explanation on the allegations levelled against the petitioner. It appears that the petitioner has submitted his explanation on 23.02.2015, but so far, enquiry is not completed and the suspension is not revoked. The Human Resources Policy and the circular instructions from time to time prescribe one month time to complete the enquiry on the allegations leveled against the Field Assistant. In the instant case, it is more than one year three months and so far, enquiry is not completed.

2. Having regard to the peculiar facts of this case, the Project Director and Additional District Programme Coordinator, District Water Management Agency, East Godavari District, Kakinada (3rd respondent) is directed to finalize the disciplinary proceedings and pass order within a period of four (4) weeks from the date of receipt of copy of this order. Failing to pass orders within the time granted and the delay in conclusion of proceedings is not attributable to petitioner, the petitioner shall be reinstated as a Field Assistant. The Writ Petition

is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _____________________ P.NAVEEN RAO, J Date: 16th December, 2015 KL
