HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE Ms JUSTICE J.UMA DEVI Writ Petition No.29352 of 2015 Order: (per VRS, J.) Contending that by overlooking her claim for promotion to the post of Senior Assistant, the 4th respondent was promoted, the petitioner has come up with the above writ petition.
2. Heard Mr. N.Krishna Sumanth, learned counsel for the petitioner and Ms. V.Uma Devi, learned Standing Counsel for the High Court.
3. It appears from the Service Records of the petitioner and the 4th respondent that while the petitioner was appointed on compassionate grounds to the post of Record Assistant on 04-5-1996, which happens to be in the Andhra Pradesh Last Grade Government Service, the 4th respondent was appointed as a Copyist in the Judicial Ministerial Service way back on 23-02-1983. Therefore, the fact that the 4th respondent was senior to the petitioner, is a fact that cannot be controverted.
4. The 2nd grievance of the petitioner is that the 4th respondent was not qualified for promotion. But it appears that the 4th respondent was also qualified as per the Rules and both the petitioner as well as the 4th respondent came within the zone of consideration. It is only after finding that the 4th respondent was qualified, that he was promoted
considering his seniority. Hence, the grievance of the petitioner does not appear to be legally sustainable.
5. Hence, the writ petition is dismissed. However, as and when the turn of the petitioner comes, she may be considered in her own right. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
