HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29661 OF 2018 ORDER:
The present writ petition came to be filed seeking a direction to the respondents not to seize the bore well dug by the petitioner and allow him to utilize the same by suspending the proceedings dated 2.6.2018 of the 3rd respondent-Tahsildar, pending disposal of the appeal in R.O.C.B4/2252 of 2018, along with the stay petition, pending before the 2nd respondent-Sub Collector.
When the matter is taken up for hearing, learned counsel for the petitioner submits that questioning the order dated 2.6.2018 of the 3rd respondent seizing the bore well of the petitioner, petitioner filed an appeal before the 2nd respondent-Sub-Collector in R.O.C.B4/2252 of 2018, along with the stay petition and which are pending consideration. Having regard to the fact that the petitioner is using the bore well for the last five years, the writ petition is disposed of directing the 2nd respondent-Sub Collector, to pass appropriate orders, in accordance with law, either in the stay petition or in the above said appeal, as the case may be, as early as possible, preferably within a period of six to eight weeks from today, by giving reasonable opportunity of hearing to the petitioner and all the concerned. Till such time, status quo existing as on today shall be maintained with regard to the usage of bore well. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
