O R D E R
This writ petition is filed for a writ of mandamus declaring the action of the respondents 1 and 2 in not supplying the essential commodities to the petitioner in respect of 200 cards of Thimmapur Harijanawada which were allotted to the petitioner's fair price shop at VenkatReddy palli Village, as illegal and arbitrary and for a consequential direction to the respondents 1 and 2 to supply the stocks to the petitioner.
Learned counsel for the petitioner submits that though the interim order is in operation, the appointment on permanent basis is made. Learned Assistant Government Pleader produced a letter dated 09.06.2015 which shows that the petitioner was appointed on temporary basis and already the said post was notified on 01.11.2013 for permanent appointment. It also shows that one Smt.Saileela was appointed as permanent fair price dealer vide proceedings dated 28.12.2013 and essential commodities were also allotted from February, 2014.
When the appointment is made on permanent basis in the year, 2013 and essential commodities were supplied to the permanent fair price shop dealer, the petitioner could have challenged the said appointment but the petitioner did not do so.
In view of the same, the cause in the writ petition no longer survives for adjudication. Hence, the writ petition is closed. There shall be no order as to costs.
