Pradeep Goel, v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37179 of 2016 ORDER:
1.
This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to take action against the Deputy Commissioner, Sales Tax, Vijayawada Range. 2.
Heard and perused the material available on record. 3.
It is the case of the petitioner that the Deputy Commissioner, Sales Tax, Vijayawada Range collected Rs.3 lakhs from him for issuance of audit clearance certificate. But he did not issue the same and he demanded some more money. As the petitioner refused to give the money as demanded, the staff of Deputy Commissioner raided his shop and filed a false case against the petitioner. It is the grievance of the petitioner that on the complaint lodged by the petitioner against the said Deputy Commissioner, even though respondents Nos.2 and 3 registered a case against him, they have not completed the investigation so far and they have not taken any action.
4.
Considering the circumstances of the case and the grievance of petitioner, this Court is inclined to pass the following order: "Respondents Nos.2 and 3 are directed to complete the investigation in Crime No.9/RCA CIU/2016, dated 15.6.2016 registered against Seethalam Sekhar, Deputy Commissioner-2 Division, Sales Tax, Vijayawada Range, and file a final report, as expeditiously as possible, in accordance with law." 5.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 15th November, 2016 Nn
