HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.23133 of 2004 DATED: 23.11.2015 Between:

Chaitanya Mahila Mandali (CMM) ... Petitioner and Union of India and others ... Respondents

THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.23133 of 2004

ORDER: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale) This Writ Petition, in the nature of PIL, is pending since 2004. Last it was placed before the Court on 23.09.2005. Thereafter, petitioner organization never bothered to take it before Court. We have perused the prayer and so also the counter-affidavit filed by respondent No.9 wherein they have specifically stated that the HIV tests were conducted on 28.10.2004 and the police never forced the sex workers for conducting the tests. They have also stated that the sex workers underwent HIV test voluntarily.

Keeping that in view and considering the passage of time, in our opinion, this Writ Petition need not be kept pending any further and deserves to be disposed of as rendered infructuous. Writ Petition is disposed of as infructuous. This, however, shall not preclude either petitioner or any other person from taking appropriate remedy, if the circumstances so demand. Consequently, miscellaneous petitions, if any, also stand disposed of. No order as to costs.
