THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1967 OF 2015 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 23.07.2015, passed in M.P.No.16 of 2015 in F.C.O.P.No.134 of 2015, by the Hon'ble Judge, Family Court-cum-V Additional District and Sessions Judge, Visakhapatnam, whereby the Court below directed the petitioner herein to pay an amount of Rs.10,000/- to respondent No.2 herein and Rs.5,000/- to respondent No.3 herein, payable on or before 10th of every month. Heard.

Learned counsel for the petitioner submitted that the petitioner is not having any job and he is studying M.Phil Research Scholar in S.V.University and he is not getting any financial support as scholarship/fellowship from UGC or S.V.University and as such, prays this Court to reduce the interim maintenance as ordered by the Court below.

Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions. (i) The petitioner herein is directed to pay 50% of the monthly maintenance ordered by the Court below, i.e., the petitioner is directed to pay monthly maintenance of Rs.5,000/- (Rupees five thousand only) to respondent No.2 herein and Rs.2,500/- (Rupees two thousand and five hundred only) to respondent No.3 herein, payable on or before 10th of every month;

(ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amounts ordered by the Court below, within a period of three months from today; and (iii) The trial Court is directed to dispose of the F.C.O.P.No.134 of 2015 as expeditiously as possible, preferably within a period of six

months.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
