Petitioners have filed this Writ Petition seeking a mandamus to declare the action of Respondents 2 and 3 in marking their houses situated at Sainagar, Hanamkonda, for the purpose of road widening, without issuing any notice and without following the procedure laid down under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short, 'the 2013 Act'), as arbitrary and illegal. Heard learned counsel for the petitioners.
Smt. P. Lakshmi, learned Standing Counsel for the respondent Corporation submits that the Corporation will follow the due process of law, if it wants to utilize the property of the petitioners for the purpose of road widening. Recording the said submission, the Writ Petition stands disposed of, directing the respondent authorities to follow the procedure established under the 2013 Act, duly observing the principles of natural justice. Till then, no demolition of the houses of the petitioners shall be undertaken. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
