HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 23921 OF 2004 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) In this writ petition, the petitioners make the following prayer: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue writ of Mandamus or any other appropriate writ or direction declaring the action of the 1st respondent in directing the 2nd respondent to remove the closed bund of the illegal breach of Pulikalva sub canal at 9.565 KM as illegal, arbitrary and consequently direct the 1st respondent not to remove the bund at closed breach at 9.565 KM forthwith and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case."

This Court on 22.12.2004 directed the respondents to maintain status quo as on that date in all respects. Till today, respondents have not filed counter affidavit nor have made any effort at any point of time to get the order of status quo vacated.

Keeping that in view, we dispose of the writ petition in terms of the interim order, dated 22.12.2004, with liberty to the respondents to change the status quo only after following the due process of law.
