HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29754 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 4th respondent in communicating to the respondents 5 and 6 vide proceedings dated 2.2.2018 asking them to cancel the pattadar passbooks issued in favour of the petitioner in respect of the land admeasuring Ac.5.07 gts situated at Sy.Nos.25/1,25/2 and 25/3 of Chodavaram Village and Mandal, Visakhapatnam District, as illegal and arbitrary.

Learned counsel for the petitioner submits that though the petitioner purchased the subject land through a valid registered sale deed and has been in possession and enjoyment of the same, the respondent-authorities are trying to dispossess the petitioner from the subject property.

In order to give quietus to the litigation, it will be just and proper to direct the 5th respondent-R.D.O to conduct a detailed enquiry in the matter and hear the petitioner and all the concerned and then pass appropriate orders, as early as possible, preferably within a period of eight to twelve weeks from today after giving the reasonable opportunity of hearing to the petitioner and all the concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
