None appears on behalf of the petitioner.
This petition has been preferred for quashing the charge sheet in C.C.No.253 of 2009 on the file of Judicial First Class Magistrate's Court, Kamalapuram, Kadapa District.
The 2nd respondent is the defacto complainant, who is the wife of the petitioner herein. The complaint lodged by the 2nd respondent, FIR.No.118 of 2009, has set out that she was married to the petitioner herein on 07.05.2007 and that she was also blessed with a son from out of the wedlock. On 26.07.2009 at about 11.30 p.m. the petitioner herein along with accused Nos.2 and 3 beat her and driven her out of the home with her minor son and then she went to her parents' house at Yerraguntla and lodged the complaint. The police have investigated the matter. The defacto complainant is working as a teacher at ZP High School, Chennur while the petitioner is working as Librarian in RIMS, Kadapa. It appears that some of the allegations made by the defacto complainant are supported by other witnesses. It appears L.Ws.6 and 7 intervened and held mediation and chastised the accused. However, the accused have not changed their ways. Since the investigation of the police has revealed material behind the allegations, charge sheet is filed and is taken on record as C.C.No.253 of 2009.
Learned Public Prosecutor would submit that the matter is now posted to 12.06.2015 for examination of the witnesses.
I, therefore, do not see any justifiable reason or ground for quashing the charge sheet. Hence, the petition is dismissed. No costs. _______________________________________ JUSTICE NOOTY RAMAMOHANA RAO 08.06.2015 Ksp
