THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 12267 OF 2017 O R D E R :

Complaining that the 2nd respondent Municipality has been interfering with the construction activities carried out by the petitioners in plot No. 1 (part) measuring 300 square yards in Survey No. 122 (Survey No. 122/A) of Tandur and in remaining part of 200 square yards of Plot No.1 situated at Ward No. 4, Blot No. 1, Chincholi Main Road, Tandur Municipality, Ranga Reddy District, this Writ Petition has been filed.

The case of the petitioners is that they are the owners and possessors of the above-said land and have been carrying out the construction, after obtaining necessary permission therefor. However, the 2nd respondent authorities visited the site on 04.04.2017 and high-handedly taken away the construction material duly threatening the workers present there. Heard learned counsel for the petitioners.

Sri N. Praveen Kumar, learned Standing Counsel for the 2nd respondent submits that the 2nd respondent authorities will not interfere with the construction activities of the petitioners, without following the due process of law.

Recording the submission made by the learned Standing Counsel, the Writ Petition is disposed of directing the 2nd respondent not to interfere with the construction work undertaken by the petitioners in the subject property, except by following the due process of law. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
