HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35674 of 2016 ORDER:

This writ petition is filed seeking to declare the inaction of the 5th respondent by not taking appropriate legal action against 6th respondent as per the complaint given by the petitioner on 07.07.12016, as illegal and arbitrary.

Heard and perused the material available on record. The main grievance of the petitioner is that the 6th respondent filed criminal case under Section 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act before the 5th respondent vide Crime No.135 of 2013, one DVC No.2 of 2015 before the Additional Junior Civil Judge Court, Repalle, against petitioner and his family members and that after conducting enquiry in the said Crime, the petitioner's name is deleted from the criminal case. The 6th respondent had taken permission to serve the notice to the petitioner in DVC No.2 of 2015 from the learned Civil Judge and without serving the summons to the petitioner, the 6th respondent obtained forged signatures on behalf of the petitioner and other attesters on summon copy and filed the same before the learned Civil Judge. The petitioner gave a complaint to the 5th respondent on 07.07.2016 against the 6th respondent regarding the same.

Considering the grievance of the petitioner, the 5th respondent is directed to register a case against the 6th respondent, if the complaint lodged by the petitioner, dated 07.07.2016, discloses any cognizable offence and investigate into the same and file a final report, if any. If the petitioner is aggrieved

by the action of the 5th respondent, he is at liberty to approach the superior officer of the 5th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st October, 2016 KL
