HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL REVISION CASE No.2283 OF 2011 ORDER:

This criminal revision case is filed by the petitioner/defacto complainant, under Sections 397 and 401 of Cr.P.C., aggrieved by the order dated 17.06.2011 in Criminal Revision Petition No.64 of 2010 passed by learned XI Additional District and Sessions Judge, Krishna at Gudivada, allowing the revision petition and setting aside the order in Crl.M.P.No.2255 of 2010 in C.C.No.290 of 2010 passed by the learned Judicial Magistrate of First Class, Kaikalur, whereunder learned Magistrate added A2 to A5 in C.C.No.290 of 2010.

Heard learned counsel for petitioner and Sri P.N.Murthy, learned counsel for respondents 1 to 4. 3.

When the matter is called, learned counsel for respondents 1 to 4 would submit that in C.C.No.290 of 2010, trial has taken place on the file of Judicial Magistrate of First Class, Kaikalur and by virtue of the judgment dated 08.12.2014, the sole accused was found not guilty and accordingly, he was acquitted. Learned counsel, thus, submit that since the main case itself was ended in acquittal against the sole accused and the matter is no more pending, the present criminal revision case, which is filed questioning the order in revision deleting the names of A2 to A5 in the array

of accused became infructuous. He, thus, prayed to dismiss the criminal revision case. Learned counsel filed a copy of the judgment in C.C.No.290 of 2010 to buttress his submission. Learned counsel for petitioner has not controverted the above facts.

In that view of the matter, this criminal revision case is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ___________________________ U.DURGA PRASAD RAO, J 31.10.2018 SS
