THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2010 of 2014 ORDER:

This Contempt Case is filed alleging non-implementation of the order passed by this Court on 16.08.2013 in W.P.M.P.Nos.45387 & 45388 of 2012 in W.P.No.35716 of 2012. It has come on record that the petitioners earlier filed C.C. No.2318 of 2013 against the said order dated 16.08.2013 and this Court closed the said Contempt Case on 06.03.2014 with the following observations:

"2. After the matter had undergone a couple of adjournments, the respondent herein has issued proceedings vide Lr.No.5348/A1/2012, dated 5.3.2014. The said order shows that the proposals with regard to payment of pensionary benefits have been submitted to the Accountant General and the proposals relating to compassionate appointment have been forwarded to the District Educational Officer, Hyderabad for appropriate action. As far as the difference of amount payable to the petitioners upon conversion of the post of the deceased employee, the District Educational Officer was requested to verify the said claim. A copy of the said order is placed on record.

3. In view of the same, since the order of this Court has been substantially complied with, I am not inclined to proceed against the respondent for contempt.

4. Accordingly, this contempt case is closed. No order as to costs."

Alleging violation of the same order dated 16.08.2013, the present Contempt Case is not maintainable, when once the earlier Contempt Case was closed. However, it is open to the petitioners to urge their grievance in the main writ petition, which is pending. Accordingly, this Contempt Case is dismissed. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
