THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15062 OF 2017 O R D E R :

This Writ Petition is filed to declare the action of Respondents 2 to 4 in trying to dig pit under the balcony of the petitioner's property bearing House No. 1-5-1/2 situated at Jagityal Municipality, for installation of 11 KV Electric Pole and transformer, as arbitrary and illegal.

Heard learned counsel for the petitioner as well as learned Standing Counsel for Respondents 3 and 4 The grievance of the petitioner is limited and against the 4th respondent. For the purpose of road widening, if the electric supply line laid by the 4th respondent is required to be shifted and in the process, the property of the petitioner is getting affected, the 4th respondent shall ensure payment of adequate compensation. It is also made clear that the 4th respondent shall, in turn, be entitled to claim the same from the 1st respondent.

Subject to the above, the Writ Petition stands disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
