HON'BLE SRI JUSTICHE K. LAKSHMAN WRIT PETITION No.41482 of 2022 ORDER:
Heard Sri Yakarapu Sheelu, learned counsel appearing for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.
The petitioner is claiming that he is the absolute owner and possessor of land admeasuring Ac.0-25 gts., in Sy.No.455/1 situated at Armoor village and Mandal, Nizamabad district. In proof of the same, he has filed copies of sale deeds, old pass books and new pass book. He had submitted F-line application dated 11-03-2022 with respondent No.6 with a request to conduct survey, demarcate the aforesaid land by fixing the boundaries. On receipt of the said F-line application, respondent No.6 issued notice bearing No.B1/911/2022, dated 08-04-2022 and fixed survey on 18-04-2022.
According to learned counsel appearing for the petitioner, no survey was conducted on 18-04-2022. Thereafter he had issued another notice fixing survey on 25-04-2022. Even on the said date also, no survey was conducted. Therefore, the petitioner herein filed the present writ petition.
Whereas learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.6 will complete survey, in accordance with law and submit report to the petitioner as well as respondent No.4. In view of the aforesaid discussion, this writ petition is disposed of, directing respondent No.6 to complete survey, pursuant to aforesaid notices bearing No.B1/911/2022, strictly in accordance with law by putting the petitioner and all affected parties on notice and affording them an opportunity of hearing. He shall submit a report to petitioner as well as respondent No.4. If respondent No.6 is not inclined to conduce survey, he shall assign specific
reasons, pass a reasoned order and shall communicate the copy of said order to the petitioner. He shall complete the entire exercise within a period of forty five (45) days from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. __________________ K. LAKSHMAN, J November 15, 2022 PN
