O R D E R

The grievance of the petitioner is that though the alleged offices against him in FIR.No.96 of 2018, are punishable less than seven years, the respondent - police authorities are threatening to arrest him without following the procedure under Section 41-A of Cr.P.C.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Having regard to the facts and circumstances of the case and the submissions of the learned counsel, writ petition is disposed of directing the 3rd respondent - Station House Officer, Darsi Police Station, Darsi, Prakasam District, to follow the procedure under Section 41-A of Cr.P.C. and the guidelines laid down by Apex Court in ARNESH KUMAR vs. STATE OF BIHAR1 and take appropriate action in accordance with law.
