THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.23262 of 2016 ORDER:

It is represented by the learned Government Pleader for Home appearing for respondents that the request of petitioner for extension of Parole has been examined and was rejected by the 1st respondent in Memo No.9508/Ser.III/A2/2016 dt.16-07-2016.

Learned Government Pleader for Home stated that as per para-17 of the existing Prison Rules, vide G.O.Ms.No.647, Home (Prisons) Department, dt.23-101981, the period of release on parole shall not ordinarily exceed one month and further extension cannot be granted and that the Government would decide the period of such releases on the merits on each case in exceptional circumstances. Reference was also made to para-21 of the said Rules, which state that the continued illness of a relative of a prisoner shall not be considered as a reasonable ground to justify the grant of extension of the period of release on parole already sanctioned. 3.

Petitioner/party-in-person states that his mother is suffering from kidney stones and that she requires

treatment and that was why he wants extension of his parole.

4. Since the petitioner had already been released on parole earlier, and since Rules prohibit extension of parole in the circumstances quoted by petitioner, I do not find any merit in the Writ Petition and it is accordingly dismissed. No costs.

5. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
