.....RESPONDENT Petition Under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of writ of certiorari or any other appropriate writ after calling for the records in l.D.No. 49 of 2014 on the file of Labour Court-l, Hyderabad and quash the Award in l.D.No. 49 ot 2O14 dated 23.01.2017.
|.A.NO:1 OF 2024 Petition Under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permit the writ petitioner to withdraw the amount of Rs.12,5,OO0l- deposited by the writ petitioner before the Hon'ble Labour Court-|, Hyderabad. THE HON'BLE SRI JUSTICE NAMAVARAPU RAJESHWAR RAO Heard Smt. K. Udaya Sri, learned counse['for the petitioners and learned counsel for the respondent.

The present Writ Petition is filed challenging the Award in I.D.No.49 of 2OL4 on the file of Labour Court-I, Hyderabad, and quash the same.

Learned counsel for the petitioners submits that this Court on 10.09.2018 passed interim order as under:
"Prima Facie, Labour Court erred in awarding same amount to all workmen irrespective of service rendered by them and since respondent worked for about 7 years, same amount as awarded to persons. with longer service may not be justified. Subject to petitioners depositing an amount of Rs.1,25,000/- (Rupees one lakh and twenty five thousand only) within two weeks, there shall be interim stay as prayed for."
4. . When the matter is taken up for hearing, learned counsel for !
I I I the petitioners submits that during the pendency of the Writ petition, the respondent filed E.P.No.2 of 2018. In the said E. P. a joint memo was filed by the petitioners as well as the
,i r*) respondent, wherein the petitioners herein had agreed to pay Rs.1,50,000/- towards full and final settlement of the claim of the respondent. Accordingly, the petitioners paid the said amount. As such, the Labour Court closed the E.P. on 2L.72.20t8. 5.
Learned counsel for the petitioners filed I.A.No.l of 2024 to withdraw the amount of Rs.1,25,000/- deposited by them in compliance of this Court order dated 10.09.2018. 6.
The said submissions made by the learned counsel for the petitioners is not disputed by the learned counsel for the respondent.
7. In view of the above submissions, the petitioners are permitted to withdraw the amount of Rs.t,25,0OO/-. 8.
Accordingly, the I.A. is ordered. Consequently, the Writ Petition is closed.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
