This application is filed to withdraw Transfer O.P.No.10 of 2015 from II Additional Senior Civil Judge, Nandyal and transfer the same to Senior Civil Judge, Tirupathi to be tried along with H.M.O.P.No.64 of 2015.
Wife filed this application.
According to her affidavit, her marriage with respondent was performed on 6-2-2014 at Tiruchanur, Tirupathi, Chittoor District and immediately after marriage, differences arose between herself and respondent and that the respondent filed O.P.No.10 of 2015 before the II Additional Senior Civil Judge, Nandyal for dissolution of marriage and that she filed H.M.O.P.No.64 of 2015 before the Principal Senior Civil Judge, Tirupathi for restoration of conjugal rights. It is contended that she is presently working at Bangalore and it is difficult for her to attend Nandyal Court which is at a distance of 500 K.M. from Bangalore and Tirupathi is only at a distance of 200
K.Ms. and it has got access both through road and air for performing the journey and taking her convenience into consideration, she sought transfer of O.P. 10 of 2015 from II Additional Senior Civil Judge, Nandyal to Principal Senior Civil Judge, Tirupathi. Respondent in spite of service of notice, neither appeared in person nor through any advocate.
Heard arguments.
Advocate for petitioner submitted that the contentions of both parties in both the O.Ps. is one and the same and these two petitions have to be tried in one court to avoid conflicting opinion. He further submitted that as the petitioner is working at Bangalore and she being a lady, her convenience may be considered for trial of these two cases at one place. I have perused the material papers.
Considering the submissions of advocate for petitioner and also affidavit of wife which is not challenged, O.P.No.10 of 2015 is withdrawn from II Additional Senior Civil Judge, Nandyal and transferred to Principal Senior Civil Judge, Tirupathi to be tried along with H.M.O.P.No.64 of 2015 in accordance with law.
This Transfer C.M.P. is allowed accordingly. No costs.
As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
