This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking bail in S.C.No.394 of 2015 on the file of the Metropolitan Sessions Judge, Visakhapatnam, registered for the offence under Section 20(b)(1) read with Section 8 of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioner/A.1 is that he along with the other accused was found in possession of 160 kgs of ganja. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is falsely implicated in the case. He prays this Court to grant bail to the petitioner. Considering the fact that the quantity of ganja, which was found in possession of petitioner/A.1 is commercial quantity, this Court is not inclined to grant bail to the petitioner/A.1. The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 10.12.2015 pln
