THE HON'BLE SRI JUSTICE S.RAVI KUMAR Tr.C.M.P.No.655 of 2015 ORDER:

This petition is filed to withdraw F.C.O.P No.59 of 2014 from Family Court, Kurnool and transfer the same to Family Court, Anantapur.

2. Petitioner herein is wife of the respondent. She filed the present application stating that she is a resident of Uravakonda, Anantapur District and her marriage with respondent was performed on 14.02.2013 at T.T.D Kalyana Mandapam, Anantapur and respondent filed this F.C.O.P before Family Court, Kurnool with false and baseless allegations. She stated that she is now working at Bangalore and her parents are residing at Uravakonda, Anantapur District and it is difficult for her to travel from Bangalore to Kurnool for the purpose of this F.C.O.P and that her parents are not in a position to accompany her to Kurnool and she has to travel alone for the adjournments. For these reasons, she prayed for transfer of F.C.O.P from Family Court, Kurnool to Family Court, Anantapur.

3. Respondent has not filed any counter.

4. Heard both sides.

5. Advocate for respondent submitted that respondent has no objection, but his presence may be dispensed with before Family Court, Anantapur for each and every adjournment.

6. Considering the submissions of both sides and considering the convenience of wife, F.C.O.P No.59 of 2014 is withdrawn from Family Court, Kurnool and transferred to Family Court, Anantapur for disposal in accordance with law. Family Court, Anantapur shall dispense with

the presence of husband i.e., respondent herein for each and every adjournment. However, he shall appear as and when his physical presence is felt necessary for any specific purpose.
