HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29770 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of a writ of mandamus to declare the action of the respondents, particularly respondent Nos. 3 and 4 in not preventing the respondents No.5 to 7 from encroachment of petitioner land, by considering the petitioner's representations dated 15.06.2018 and 25.06.2018, as illegal, arbitrary and unconstitutional.

The learned counsel for the petitioner mainly submits that the petitioner, who is aged about 80 years, is the absolute owner and is in possession of the land admeasuring Ac.1.25 gts., in Sy.No. 256/ AA situated in Gudiwada Vilage, Kethepally Mandal, Nalgonda district. It is stated that the Government of Telangana surveyed the entire lands in the State and introduced the Dharani website for the purpose of issuance of pattadar pass books and title deeds. It is further stated that on 02.07.2018, pattadar passbooks and title deeds came to be issued to the petitioner along with the government financial support.

While matters stood thus, the respondents 5 to 7 are trying to interfere with the possession of the petitioner and that the 3rd and 4th respondents are hand-in-glove with the

respondents 5 and 7 in trying to evict the petitioner from the said land. Hence, the present writ petition. 4.

The learned Government Pleader for Revenue obtained instructions and placed on record the endorsement dated 20.08.2018, which would show that the land was assigned by way of Lavone patta under the Raithu Bandhu scheme in favour of the petitioner and pattadar passbook bearing No. T28130020236 came to be issued to the petitioner. It is further stated that no effort is made by anybody to encroach on to the said land. It is also stated that if any encroachment is made, the petitioner is at liberty to approach the Station House Officer, Kethepally Mandal.

Recording the contents of the endorsement dated 20.08.2018, the present writ petition is disposed of with consent, at the admission stage. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
