HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19960 of 2017 ORDER:

Heard Sri V.V. Raghavan for petitioner and the learned Assistant Government Pleader (Revenue) for respondents 1 to 3.

2. The petitioner prays for the following relief: " ....declare that the assignment of burial ground to the respondents 5 to 112 as house sites as illegal and arbitrary and issue a writ or order particularly in the nature of writ of mandamus setting aside the assignment in favour of respondents 5 to 112 and pass such other orders."

3. From the above, it is clear that the assignment of house site pattas in a burial ground is challenged by petitioner. The assignment, if granted not only in burial ground, but at any other place, a person aggrieved by the assignment, can certainly file an appeal before the Revenue Divisional Officer.

4. The petitioner is given liberty to file an appeal challenging the assignment in favour of Respondents 5 to 112 within four weeks from today and the Appellate Authority is directed to hear and dispose of the appeal on merits. The parties are directed to maintain status quo as regards possession and physical features of Sy.No.297/ 1 of Racherla Village, Pentapdu Mandal, for a period of four weeks from today.

5. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
