THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO C.E.A. No. 48 of 2005 JUDGMENT: (per the Hon'ble Sri Justice Dilip B.Bhosale) Learned counsel for the appellant invited our attention to the judgment of this Court in Commissioner of Central Excise, Visakhapatnam-I Vs. Hindustan Zinc Limited[1] and submitted that in view of this judgment, the instant appeal may be dismissed confirming the order passed by the Tribunal, dated 19.10.2004. He submits that the question of law raised in the instant appeal is squarely covered by the judgment in Hindustan Zinc Limited's case (supra).

In the circumstances, the appeal is dismissed in view of the judgment of this Court in Hindustan Zinc Limited's case (supra) and the order passed by the Tribunal is confirmed. No costs. Consequently, miscellaneous petitions, if any, also stand disposed of.
