HON'BLE SRI JUSTICE S.V. BHATT W.P. No.22833 OF 2017 ORDER:

Heard learned counsel for petitioner and the Assistant Government Pleader (Revenue) for respondents. The petitioner challenges the order of 3rd respondent in Rc.H.1250/ 2017 dated 07.07.2017, as illegal and violative of principles of natural justice.

The issue arises under the A.P. Land Encroachment Act, 1905 (for short 'the Act'). After arguing the matter for some time, counsel for petitioner requests the Court to permit the petitioner to avail the remedy under Section 12-A of the Act. He further submits that having regard to the manner in which eviction orders are passed by respondents 3 and 4, there is every likelihood of respondents implementing the orders impugned in the writ petition and in such an event, the petitioner would be put to great loss and hardship. He submits that for a while, the interest of petitioner may be protected.

I am satisfied that the effective remedy under Section 12-A of the Act can be worked out by the petitioner. Hence, the writ petition is disposed of by giving liberty to petitioner to file revision within four weeks from today and the parties are directed to maintain status quo as regards physical features and possession for a period of three months from today. The application filed by petitioner for interim order is directed to be considered and

disposed of before the expiry of three months' period granted by this Court.

No order as to costs.
