THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.29856 of 2018 ORDER:

Petitioner has assailed Form-V notice dt.13-08-2018 issued by 3rd respondent proposing to conduct meeting on 27-08-2018 to consider notice of No Confidence Motion given by other members of Mandal Praja Parishad against the petitioner, who is the President of the 4th respondent Mandal Praja Parishad.

Though learned counsel for petitioner contended that Form-V notice served on petitioner was not accompanied by copy of notice of Motion contained in Form-II, petitioner herself has filed Form-II notice dt.30-07-2018.

That apart, petitioner contended that 15 days clear notice should be there between service of Form-V notice and the date on which the meeting is scheduled to be held.

Rule 3 framed under G.O.Ms.No.200, Panchayat Raj and Rural Development (MdI-II) Department dt.28-04-1998 requires 15 days clear gap between the date of the notice and the date of the proposed meeting and it has not provided for counting of the period from the date of service of notice. In any event, no significany prejudice to the petitioner is pointed out even assuming that there is any short fall in 15 days period when it is counted from 30-07-2018.

I therefore do not find any merit in the Writ Petition warranting interference by this Court under Article 226 of the Constitution of India.

Accordingly, the Writ Petition is dismissed at the admission stage. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
