O R D E R

Heard Sri T. Nagarjuna Reddy, learned counsel for the petitioners, and Sri Md. Saleem, learned Standing Counsel for the Nandikotkur Municipality.

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Honourable Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, Order or direction declaring the action of the 2nd Respondent herein in trying to demolish the Shop rooms bearing Nos.2-121, 2-122, 2-123, 2-134, 2-135, 2-136 and 2137, 4-208, 2-22, 2-23, 2-110, 2-111, 2-112, 4-114, 12-123, 19-197, 11-277, 12-120, 2-163, 12-114, 12-113, 4-124, 12-105, 12-104, 11-258 and 4-125 belonging to the Petitioners respectively situate in K.G.Road, Nandikotkur, Kurnool District, as arbitrary, illegal, unconstitutional and against the principles of natural justice and consequently direct the 2nd Respondent herein not to demolish the Shops belonging to the Petitioners without following due process of law and pass such other or further orders as this Honourable Court may deem fit and proper in the circumstances of the case."

Sufficient documents are filed in evidence of the petitioners' possession.

In that view of the matter, the writ petition is disposed of directing the Nandikotkur municipal authorities not to interfere with the subject properties in the possession of the petitioners except in accordance with the due procedure laid down by law.

Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
