Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ, order or direction, more particularly a writ in the nature of Writ of MANDAMUS declaring the action of the 3rd respondent i.e., Founder Trustee of Sri Chandrasekhara Swamy Temple, Ch.Agraharam Village, Ganapavaram Mandal, West Godavari District in issuing notice dated 27-062015 contemplating to hold public auction of the leasehold rights of the lands belonging to the 3rd respondent temple at Ch.Agraharam Village, Ganapavaram Mandal, West Godavari District admeasuring an extent of Acs.1-63 cents in Sy.No.
69/1 situated at Vallur Village on 11-07-2015 as bad, illegal, arbitrary, opposed to law and violation of principles of natural Justice. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and order of the High Court dated 14-07-2015, 16-07-2015, 21-07-2015, 30-07-2015, 20-08-2015 & 15-09-2015 made herein and upon hearing the arguments of Sri M. Vidyasagar, Advocate for the Petitioner, GP for Endowments (AP) for Respondent Nos.1, 2 & 4 and Smt. K. Lalitha, Standing Counsel for Respondent No.
Learned standing counsel represented that founder member of the temple lodged a complaint with the police against his employee Mr. K. Nagababu, who was earlier working with the temple alleging that letter heads were misused to show as if annual maktha is paid and because of pendency of this writ petition, no action is taken by police concerned. It is made clear that writ petition is only concerning grant of lease, continuation of the possession of the petitioner in the lease hold property including determination of status of the petitioner as landless
person and is nothing to do with other issues concerning the temple. Interim stay granted earlier is extended till 31.10.2015. List after Dasara vacation, 2015.
