THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION NO.29910 OF 2018 O R D E R : (Per Hon'ble Sri Justice Sanjay Kumar) Petitioners are the unsuccessful applicants in O.A.No.957 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. Their prayer therein was to declare the action of the authorities in issuing a 2nd merit list in May, 2018 based on the marks obtained in X Class superseding the 1st merit list prepared on the strength of the marks obtained in Technical qualification, as illegal.

By order dated 17.05.2018, the Tribunal dismissed the O.A. Therein, the Tribunal took note of the fact that X Class was the basic requisite qualification apart from the technical course and, therefore, taking into account the marks secured in both was not illegal.

The notification issued by the Integrated Tribal Development Authority, Rampachodavaram, indicates that in so far as the post of Multi Purpose Health Assistants (MPHA) was concerned, the requisite qualification was a pass in X Class apart from the requisite training certificate. No indication was given in the notification as to one or the other being given priority to the exclusion of the other.

That being so, the action of the authorities in taking into account the marks secured in X Class also and thereby preparing a fresh merit list cannot be said to be illegal. The order of the

Tribunal holding to this effect does not call for interference by this Court.

The Writ Petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
