THE HON'BLE JUSTICE G. SRI DEVI AND THE HON'BLE SMT. JUSTICE M.G. PRIYADARSINI F.C.A.No. 61 of 2017 JUDGMENT: (per Justice G. Sri Devi) 1) The present appeal is filed against the order and decree dated 18.03.2016 passed in O.P.No.299 of 2010 on the file of the XV Additional District Judge-cum-II Additional Family Judge, Ranga Reddy District, Kukatpally at Miyapur.
2) The appellant herein-husband filed the O.P.No.299 of 2010 under Section 13(1)(ia) of the Hindu Marriage Act seeking dissolution of the marriage. Vide order and decree dated 18.03.2016, the learned Judge, Family Court, dismissed the said O.P. Challenging the same the present appeal is filed by the appellant-husband.
3) During pendency of the appeal, this Court on 25.07.2022 conducted conciliation proceedings between the parties in the Chambers wherein, both the parties resolved for dissolution of marriage on certain terms arrived between them. As per the said terms, the husband will continue to take care and look after the well being of the two daughters, who are staying with him, such as educational expenses, marriage expenses etc. Moreover, the wife has relinquished her right to claim any amount towards permanent alimony. 4) Today the appellant and respondent are present and produced their original Aadhar Cards and they are identified by their respective counsel. When examined, both the parties reiterated their stand for dissolution of
marriage on the terms arrived at between them on 25.07.2022. The respondent-wife stated that she has no objection for allowing the FCA. 5) In view of the above and having regard to the settlement arrived at between the parties, we deem it appropriate to dispose of the appeal as per the conciliation terms, mentioned above.
6) Accordingly, the F.C.A. is allowed of in terms of the settlement entered between the parties. Consequently, the order dated 18.03.2016 passed in O.P.No.299 of 2010 on the file of the XV Additional District Judge-cum-II Additional Family Judge, Ranga Reddy District, Kukatpally at Miyapur, is hereby set aside and the O.P. stands allowed dissolving the marriage between the appellant and respondent that took place on 04.06.2003. No order as to costs.
Registry is directed to incorporate the conciliation proceedings dated 25.07.2022 in the decree.
