HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18455 OF 2012 O R D E R :

This writ petition is filed against the proceedings dated 04.06.2012 issued in No.TY/95(181)/2012, GWK placing the petitioner under suspension pending enquiry.

This Court on 25.06.2012 granted interim order and the same was made absolute on 21.11.2014.

Counter affidavit is filed by the respondents 1 and 2 stating that by virtue of interim order granted by this court on 25.06.2012, petitioner was taken into service and is continuing. Learned counsel for the petitioner states that since no stay is granted by this Court regarding enquiry, enquiry was conducted and punishment was imposed on the petitioner postponing one increment with cumulative effect.

Heard S.V.Ramana, learned Standing counsel for the respondents.

In view of the above, since the punishment is already imposed, continuing the petitioner under suspension does not arise. The impugned order is set aside. However, if the enquiry is not finalised, the same shall be finalised.

Accordingly, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
