THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12303 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused in Crime.No.605 of 2023 on the file of Keesara Police Station, Rachakonda, registered for the offence under Section 20 (b) (ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Keesara Police registered a case against the petitioners and two others for being in possession of kg.109.49 gms of ganja.

Learned counsel for the petitioners would submit that there is gross violation of the control orders, for which reason, the petitioners are entitled for the bail.

On the other hand, learned Additional Public Prosecutor would submit that investigation is complete and charge sheet is already filed. When questioned, she submits that there are no other criminal cases pending against these petitioners.

Keeping in view that investigation is complete and there are no criminal antecedents of the petitioners, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioners/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, i.e., one local surety and other from the native place, for a like sum each to the satisfaction of III Additional Metropolitan Magistrate, at Malkajgiri.

ii) The petitioners/Accused after release shall appear before the concerned Court on every date of hearing.

iii) The petitioners/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
