THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19067 OF 2016 O R D E R:
The petitioner claims to be the owner and possessor of agricultural land to an extent of Ac.0.72 cents in Survey No. 503/2 of Mynampadu Revenue Village, Santhanuthalapadu Mandal, Prakasam District. The main complaint of the petitioner is that the respondent authorities are trying to lay the road towards the southern side of his property, without invoking the provisions under any law. The petitioner submits that he has not only represented the matter to the respondents but also got issued a legal notice, but no action has been taken thereafter.
Heard learned counsel for the petitioner and Sri G. Seshadri, learned Standing Counsel for Mynampadu Gram Panchayat. Learned Government Pleader for Panchayat Raj (Andhra Pradesh) would submit that if at all, the respondents want to lay any road, as complained by the petitioner, they would follow the procedure prescribed under law.
Recording the submission made by the learned Government Pleader, this Writ Petition is disposed of, directing the respondents not to interfere with the property of the petitioner, without following the due procedure established by law. No costs.
Consequently, the miscellaneous Applications, if any shall stand disposed of.
