HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29740 OF 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in not receiving and registering the documents submitted by the petitioners, though there is no specific order prohibiting him from registering any kind of document in respect of land admeasuring 445.4 square yards in R.S.No.430 of 2011 and 460.68 square yards in R.S.No.430/ 2011, Poranki Village, Penamaluru Mandal, krishna District, as illegal and arbitrary.

2) The grievance of the petitioners is that petitioners are the absolute owners and possessors of the subject land, having purchased the same through registered sale deed bearing No.1205 of 1997 dated 13.09.1996, from K.Venkateswara Rao. While things stood thus, in order to develop the above said land, they presented a document before the fourth respondent for registration, who refused to receive the same. Challenging the same the present writ petition came to be filed.

3) Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the fourth respondent-Sub Registrar, to receive the documents for registration, if they are in accordance with the law. If the fourth respondent is not intending to register the documents presented by the petitioners, the fourth respondent, shall return the same assigning the reasons, as early as

possible, preferably, within a period of four weeks from today, after giving an opportunity of hearing to the petitioners and all the concerned.

4) With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending shall stand closed.
