O R D E R
Heard Sri Krishna Devan, learned counsel for the petitioner, and Sri S.D.Gowd, learned standing counsel for Chittoor Municipality. The prayer of the petitioner in this case is as under: 'For the facts and circumstances stated in the affidavit, it is prayed that the Hon'ble court may be pleased to issue an order, direction or a W.P more particularly in the nature of Writ of Mandamus by declaring the action of the respondents in taking up the demolition of the buildings including the petitioner on 30-3-2016 (or) after without following the due process established under the Law as arbitrary, unlawful and illegal, highhanded and abuse of process of Law and in violation of Principles of Natural Justice amounting to violation of Article 14, 21 and 300 A of the Constitution of India and consequently direct the respondent authorities not to interfere with the peaceful possession and enjoyment of the property held by the petitioner herein and pass such other or further orders as deemed fit and proper in the circumstances of the case.'
In the light of the documents placed on record by the petitioner in proof of her possession and title over the subject property, the writ petition is disposed of directing the respondent authorities not to interfere with the petitioner's possession or resort to demolishing of the subject property, except in accordance with the due procedure laid down by law. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
