THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24038 of 2016 ORDER:

This Writ Petition is filed alleging that entries in the revenue records are sought to be varied in favour of the fifth respondent.

It is the case of the petitioner that his name is mutated in the revenue records and he was issued pattadar pass books vide proceedings No.392/2015, dated 08.05.2015. Now, he came to know that the fifth respondent has submitted an application to the fourth respondent seeking to include her name in the revenue records. Though there was no personal notice issued to the petitioner, he came to know about the same through public notice, dated 05.07.2016, which was made displayed in the fourth respondent's Office. It is the contention of the petitioner that change of entries in the revenue records as well as issuance of pattadar pass books in favour of the fifth respondent without issuing any notice to him is totally impermissible and illegal. Hence, this Writ Petition.

Inasmuch as the public notice has been issued in terms of Rule 19 of the Andhra Pradesh Rights in Land

and Pattadar Pass Books Rules, 1989 calling for objections, the petitioner may approach the fourth respondent and file his objections. As and when such objections are filed including the maintainability of the application filed by the fifth respondent, the same shall be considered by the fourth respondent in accordance with law.

Subject to the above, the Writ Petition is disposed of.

Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. There shall be no order as to costs.
