HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8833 of 2016 ORDER:
The action of respondents in taking steps for conversion of Uravakonda Gram Panchayat into Uravakonda Nagara Panchayat pursuant to memo dated 4.1.2016 of the fourth respondent without taking into consideration of the Gram Panchayat resolution, primary objection of the villagers and also subsisting tenure of the petitioner as sarpanch is challenged in the present Writ Petition.
A bare perusal of the impugned order dated 4.1.2016 reveals that it is only a communication addressed by the
Divisional Panchayat Officer, Ananthapur to respective Gram Panchayats and also to the District Panchayat Officer, Ananthapur, intimating about the desire of the Government in the meeting held on 9.9.2015 to take necessary steps for converting the Uravakonda Gram Panchayat of Uravakonda Mandal into Nagara Panchayat and to merge A.Narayanapuram Gram Panchayat of Ananthapur Rural Mandal into Municipal Corporation. Inasmuch as it is only an internal communication, there is no violation of any of the mandatory provisions of the Panchayat Raj Act or Municipalities Act or Municipal Corporations Act or G.O.Ms.No.16, Municipal Administration and Urban Development (Elec.I) Department, dated 16.01.2013. In that view of the matter, I do not see any valid and substantial reason to entertain the Writ Petition.
The Writ Petition is accordingly dismissed.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
