THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 40663 of 2015 ORDER:

The grievance of the petitioner was that the police authorities were not completing the investigation in Crime No.437 of 2014 on the file of Sanath Nagar Police Station, Cyberabad.

2. Written instructions dated 21.12.2015 were furnished by the SubInspector of Police, Sanath Nagar Police Station, Cyberabad Coimmissionerate, to the office of the learned Government Pleader for Home wherein he stated that Crime No.437 of 2014 had been registered under Sections 307, 325, 166, 167, 211 and 221 r/w Section 34 IPC on the file of Sanath Nagar Police Station upon the private complaint made by the petitioner before the XIX Metropolitan Magistrate, Cyberabad at Miyapur being forwarded under Section 156(3) Cr.P.C. Upon completion of the investigation the police authorities concluded that there was no evidence to proceed in the matter and accordingly filed a final report referring the case for 'lack of evidence'. This final report was filed under Section 173 Cr.P.C. before the learned XXIV Metropolitan Magistrate, Kukatpally at Miyapur on 19.12.2015 and notice thereof was sent to the complainant by registered post in Form No.96.

In the light of the aforestated developments, it is for the petitioner to take recourse to avail appropriate remedies in accordance with law if he is aggrieved by the final conclusion arrived at by the police authorities. Reserving liberty to the petitioner to do so, the Writ Petition is closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
