THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.9162 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) This Writ Petition is preferred against the order passed by the Andhra Pradesh Administrative Tribunal in O.A.No.7851 of 2008 dated 02.11.2010. By the said order, the petitioners herein were directed to pay interest on the gratuity amount of Rs.3,50,000/- from 01.07.2006 till the date of payment i.e. 21.02.2008 at the admissible rates as per rules; and, on the remaining amount of pension and commuted value of pension, the petitioners herein were directed to pay interest @ 8% p.a. from 01.07.2006 to 21.02.2008. The interest was directed to be paid to the second respondent, the wife of the deceased employee, within a period of six weeks from the date of receipt of a copy of the order.

Learned Government Pleader for Services would submit that, as the petitioners herein have filed the present Writ Petition, they have not complied with the order of the Tribunal. The order of the Tribunal is dated 02.11.2010 and required the petitioners herein to comply with the aforesaid directions within six weeks from the date of receipt of a copy of the order. Even if a reasonable period, for communication of the order of the Tribunal, is excluded, the petitioners were required to comply with the order of the Tribunal by the end of the year 2010. Besides not complying with the said order, the petitioners herein have also slept over the matter and have invoked the jurisdiction of this Court four years five months after the order was passed by the Tribunal. No explanation is forthcoming in the affidavit, filed in support of the Writ Petition, for the inordinate

delay in invoking the jurisdiction of this Court. The Writ Petition is liable to be dismissed on the ground of delay and latches and is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
