THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6264 OF 2017 ORDER:

Heard learned counsel for the petitioners and also the learned Public Prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent - defacto complainant and perused the grounds urged in the quash petition to quash the Crime No.122 of 2017 of Giddaluru Police Station, registered for the offences punishable under Sections 323 and 506 of IPC and Section 3(1)(r)(s) and 2(v)(a) of SC/ST (Prevention of Atrocities) Act, 2015. 2.

A perusal of the FIR no way enables the Court to interdict the investigation proceedings by entertaining the quash petition, but for to say, if at all during investigation any arrest of the petitioner required, the police strictly follow section 41A Cr.P.C. and the expression of the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

Accordingly and with the above direction, this criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
