Heard the counsel for the petitioner and the learned Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring G.O.Ms.No.99 Health, Medical and Family Welfare (M2) Department, dated 05-05-2010 issued by the 1st respondent and consequential notice of termination vide Rc.No.E1/2006/ 2010, dated 02-09-2010 issued by
the 4th respondent as illegal and arbitrary and consequently to set aside the same and to continue the petitioner as outsourcing agency as usual till expiry of contract period 31-03-2011.
At the time when the matter is taken up for hearing, learned counsel representing the learned counsel for the petitioner states that the cause in the writ petition does not survive at this point of time and that the writ petition may be dismissed.
Recording the said submission, the writ petition is dismissed as infructuous. However, if any amount is due to the petitioner, the petitioner shall make appropriate application for refund of such amount in which event the respondent authorities shall consider the same in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
