THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No.4963 of 2018 ORDER:

1) Aggrieved by the order, dated 25.06.2018, passed in O.S.No.25 of 2015 on the file of the XII Additional District Judge, Pithapuram, wherein a request of the petitioner to receive the document styled as " Parikathu Pusthakam" which is sought to be marked through PW.2 was rejected on the ground of its admissibility.

2) Though the learned counsel for the petitioner does not question the finding of the trial Court with regard to admissibility of the document, but in view of the findings in the last three lines of the order, the counsel pleads that the said document may be received in evidence, for collateral purpose.

3) As seen from the impugned order, the trial Court did not advert to the said issue since the second defendant, who is the petitioner herein, did not propose for receiving the said document, for collateral purpose.

4) Having regard to the above, the Civil Revision petition is disposed of, permitting the petitioner to raise the issue of receiving the said document for collateral purpose basing on

the observations made by the trail Court in the impugned order, if he is otherwise entitled to. In which event the same shall be dealt with in accordance with law.

5) As a sequel thereto, Miscellaneous Petitions pending if any, shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C.PRAVEEN KUMAR 31.08.2018 gkv
