THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.1442 of 2016 ORDER :

The petitioner, who is A3 in Crime No.198 of 2014 of Ghatkesar Police Station, Cyberabad, Ranga Reddy District, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 416, 417, 448, 419, 429, 447, 460, 464, 465, 468, 470 and 425 of IPC. A perusal of the material on record would show that in the complaint filed before the Court, which was referred to police under Section 156(3) of Cr.P.C., name of the petitioner was shown as A1, but in the case diary, where the petitioner is shown as A3, it has been stated as under: "As per the statements of the witnesses and confessional statements of the accused persons it is well established that there is no evidence to prove the involvement of the A3 in this case.

The A3 only real estate broker and he introducing customers to the plot owners and get his commission from the owners. He knows A1 as a real estate broker but he did not know anything regarded to this case. As such I deleted the name of A3 from this case and remaining accused is still absconding and whereabouts are not known. Efforts are on to nab them." In view of the above, question of adjudicating the matter in this petition does not arise. Hence, the Criminal Petition is dismissed. _________________________ JUSTICE C. PRAVEEN KUMAR 15.02.
