THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12503 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.2 seeking bail in crime No.297 of 2015 on the file of the Narsipatnam Prohibition and Excise Station, Visakhapatnam, registered for the offence under Section 8(1) read with 20(b)(ii) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioners/A.1 and A.2 is that they were found in illegal possession of 138 kgs of ganja. Learned counsel for the petitioners submits that the petitioners have not committed any offence and they have been falsely implicated in the case. He prays this Court to grant bail to the petitioners. Considering the fact that the quantity of ganja, which was found in possession of petitioners/A.1 and A.2 is commercial quantity, this Court is not inclined to grant bail to the petitioners/A.1 and A.2. The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 10.12.2015 pln
