This petition is filed under Section 439(1)(b) r/ w 482 of Cr.P.C. to relax the conditions imposed by the I Additional District and Sessions Judge, Guntur in Crl.M.P.No.908 of 2016, dated 24.05.2016 whereby the petitioner was directed to execute a bond for a sum of Rs.10,000/ - (Rupees ten thousand only) with two sureties for like sum to the satisfaction of VI Additional Munsif Magistrate, Guntur and on condition that the sureties should have registered title deeds and they should be residents of Guntur and on further condition that the petitioner should appear before the S.H.O. Vatticherukuru Police Station on every Sunday in between 8 to 12 noon until further orders.

The present petition is filed to relax the above conditions. However, the petitioner is native of Uttar Pradesh and the II Additional District and Sessions Judge taking into consideration of his native place, imposed such conditions.

Now, the learned counsel for the petitioner contended that the petitioner is unable to get sureties and produce before the Court to execute the bond. But, by that itself is not a ground to relax the conditons. In case the petitioner is released on bail, without insisting local sureties, there is every possibility of petitioner absconding and it is very difficult for the investigating agency to secure the presence of the petitioner during the trial.

Therefore, I find that it is a fit case to modify the conditions slightly confining that the sureties should have registered title deeds within the territorial limits of VI Additional Judical First Class Magistrate, Guntur. The other condition is to report before the S.H.O., Vatticherukuru Police Station

on every Sunday between 8 to 12 Noon until further orders is modified due to long lapse of time after imposing conditions, the condition is modified directing to report before the S.H.O., Vatticherukuru Police Station on every second Sunday between 8 to 12 Noon until further orders.
