Heard Sri A.B.Lalitha Gayathri for petitioners and Sri Keerthi Kiran Kota for 3rd respondent.
The prayers of petitioners can be summarized thus :- (a) Not to execute the award in O.P.No.2/ 13 dated 29-04-2013.
(b) Pending disposal of I.A.No.25 of 2016 filed by petitioners for condoning the delay in filing an application to set aside the Award dated 29-04-2013 and direct the Tribunal to dispose of I.A.No.25 of 2016 expeditiously.
The counsel representing 3rd respondent submits that the Award has already executed in E.P.No.29 of 2013 and further execution of the Award does not arise. As regards disposing of I.A.No.25 of 2016, it is submitted that the 3rd respondent has no objection for expeditious disposal.
Having regard to the submission of counsel for petitioners and the fact that the application in I.A.No.25/ 16 is pending before the Co-operative Tribunal, the writ petition is disposed of as follows :- The Co-operative Tribunal is directed to dispose of I.A.No.25 of 2016 within two months from the date of receipt of a copy of this order. Pending consideration of I.A.No.25 of 2016, the 3rd respondent is directed not
to realise any amount from petitioners pursuant to or in execution of Award in O.P.No.2 of 2013.
The writ petition is disposed of accordingly. No order as to costs.
