THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12312 OF 2023 ORDER:

This Criminal Petition is filed under Sections 438 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") by the petitioners/Accused Nos.1 to 30 seeking bail in the event of their arrest in Crime.No.195 of 2023 on the file of Peddakothapally Police Station, Nagarkurnool District, registered for the offences under Sections 448, 324, 323, 509, 504 and 506 r/w.34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

On 05.12.2023, written complaint was filed alleging that all the 30 petitioners trespassed into the house of the de-facto complainant and beat him and his wife. 4.
Learned counsel appearing for the petitioners would submit that the de-facto complainant received injuries elsewhere and filed a false complaint against these petitioners involving all the family members.

On the other hand, learned Additional Public Prosecutor would submit that the basis for attack is due to political reasons.

Keeping in view that initially FIR was registered under Section 324 of IPC and injured have been treated and discharged from the hospital, the prayer for anticipatory bail can be considered, subject to following conditions:-
1) The petitioners/Accused Nos.1 to are directed to surrender before the Station House Officer, Peddakothapally Police Station, Nagarkurnool District, on or before 26.12.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 to 30 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety, for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.1 to 30 shall appear before the concerned Station House Officer, for the purpose of investigation as and when required.
3) The petitioners/accused Nos.1 to 30 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 7.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
